Kenya’s Progress in Refugee Law

Kenya being a signatory to the various international conventions on the protection of refugees has made a significant progress but there is still more to be done.  Apart from the 1951 Refugee convention and its subsequent 1967 protocol, several African conventions, Kenya has had legal regimes dealing with matter refugees at a local level. The repealed Refugee Act of 2006 was not very clear in terms of how to handle refugees in Kenya.

To put it succinctly, Kenya receives a massive surge of refugees from the East Africa region and beyond due to its relatively stable political and economic situation comparatively.

Around the East African region, refugees from Somalia, Democratic Republic of Congo, South Sudan and Ethiopia continue to seek asylum from the various entry points on a daily basis. It is for this reason that Kenya recently enacted a more elaborate Refugee Act 2021 that repealed the 2006 one.
