Reprieve for Eritrean and Ethiopian Asylum Seekers Following High Court Order

We acknowledge the court order issued on 2nd October 2025 in Petition No. HCCHRPET/E596 of 2025, filed by Refugee Legal Networks alongside four other petitioners through their advocates. The petition challenges the directive issued on 31st July 2025, which suspended the registration of Eritrean and Ethiopian nationals as asylum seekers in Kenya.

In its interim ruling, the High Court has granted a conservatory order temporarily suspending the implementation of the directive until 22nd October 2025, pending further proceedings.

This directive had disproportionately affected Eritrean and Ethiopian nationals, many of whom have endured significant hardship, with their fundamental human rights impacted. Some have even been labeled as victims of human trafficking, further compounding their vulnerability.

We therefore urge all affected persons to take advantage of this court order and proceed to seek registration as asylum seekers.

We reaffirm our commitment to the protection of refugee rights and respect for the rule of law as this matter continues under judicial consideration.

Call to Action for Partners

We call on our partners—civil society organizations, legal aid providers, humanitarian agencies, and community-based networks—to:

  • Raise awareness of the court’s ruling among affected communities;

  • Support access to registration by providing information, legal aid, and logistical assistance;

  • Document ongoing challenges faced by Eritrean and Ethiopian asylum seekers during this period; and

  • Maintain pressure for a permanent, rights-based resolution through legal, advocacy, and policy engagement.

Together, we can ensure that the rights and dignity of all asylum seekers are protected and upheld in accordance with national and international law.
