Isiolo Chief Magistrates Court Criminal Case No. E 015 of 2026 Republic VS Yordan Habte & Others)

This matter involves a conviction by the Court of over 23 asylum seekers who were condemned to serve a year in prison for being in the country illegally and also fined a total of KShs. 250,000/= each. The convicts include minors. Having visited them in various police cells in Nairobi, we were able to deduce that they are indeed asylum seekers and the procedure as envisioned in the Refugee Act 2021 was not followed.
We are currently in the process of filling a revision Application in the high Court at Isiolo to set aside the orders and conviction of the Magistrates Court.
